License agreement

1. General Provisions.

1.1. "Heat Loss", "HVAC Calculator", "Psychrometric Chart", "Heat Pump", "Aerodynamics", "Kitchen Ventilation", "Pool Ventilation", "Ductwork Surface" (hereinafter collectively referred to as the "Application") is an online computer application available on the website www.softhvac.com (hereinafter the "Website").

1.2. This License Agreement (hereinafter the "License") sets the terms of use of the subscription to the Program and is concluded between any person using the Program (hereinafter the "User") and Andrii Oleksandrovych Shirshov, who is the holder of the exclusive rights to the Program (hereinafter the "Rightholder").

1.3. By purchasing a subscription and using the Program in any way, the User expresses full and unconditional agreement with all the terms of this License.

1.4. The subscription is acquired for a specific account.

2. Rights to the Program.

The exclusive right to the Program belongs to the Rightholder.

3. License.

3.1. The Rightholder grants the User a non-transferable right to use the Program worldwide, applying the Program according to its direct functional purpose.

3.2. Access to the Program is provided to the User who has an active subscription and is authorized on the Website.

3.3. Upon expiration of the subscription period, access to the Program is terminated.

3.4. At the same time, the User may be authorized in no more than one browser at a time.

4. Restrictions.

4.1. The User is not entitled to modify, decrypt, or perform other actions with the object code of the Program aimed at obtaining information about the implementation of algorithms used in the Program, to create derivative works using the Program, or to perform (or allow to perform) any other use of the Program without the Rightholder’s written consent.

4.2. The User is not entitled to reproduce or distribute the Program for commercial purposes (including for a fee), including as part of software product collections, without the Rightholder’s written consent.

4.3. The User is not entitled to transfer to third parties the login and password of the account for which the subscription to the Program was purchased.

5. Limitation of Liability under the License.

5.1. The Application is provided on an "as is" basis. The Rightholder does not provide any warranties regarding error-free and uninterrupted operation of the Program, compliance of the Program with specific purposes and expectations of the User, nor does it provide any other warranties not expressly stated in this License.

5.2. To the maximum extent permitted by applicable law, the Rightholder shall not be liable for any direct or indirect consequences of any use or inability to use the Program and/or for damages caused to the User and/or third parties as a result of any use or non-use of the Program, including due to possible errors or failures in the operation of the Program.
